What Happened In The House Of Lords About Cannabis?

Today, Baroness Molly Meacher asked a question about cannabis in the House of Lords .
There is a great deal of confusion and misunderstanding about what happened, so I shall do my best to explain.

This was not a full debate. There never was any prospect of any law being changed. It was simply a question, which would be answered by the government spokesman and Lady Meacher would then have the opportunity to ask a further, supplementary question. In the process, other members of the House would be able to interject and make their own comments.
The question was whether cannabis could be re-scheduled, out of schedule one, which determines that it has no medicinal value, to schedule two or three which would allow doctors to prescribe it and also enable researchers to access and use cannabis more easily in studies and clinical trials.
Lord Bates
The government behaved exactly as expected. The most generous interpretation is that the spokesman, Lord Bates, was misinformed. His first response to Lady Meacher’s question was to parrot the Home Office’s usual line on cannabis about it being a harmful drug.
This of course, is nothing to do with medicinal use. Most medicines are far more harmful than cannabis and any potential harms are traded off against therapeutic benefit.
I know some people are already accusing Lord Bates of being a ‘liar’ but this is not true. He simply has no idea what he is talking about and his briefing from Home Office officials is designed not to inform but to deflect, confuse and retain control within the bureaucracy. The claim that the Advisory Council recommends against medicinal cannabis is factually incorrect. The ACMD is not constituted to advise on the medicinal benefits of any drug.
So ignore what the government said. It is largely irrelevant to the process of informing and changing minds amongst those in power. They will instruct officials and spokespeople as necessary once they understand a more successful path forwards.
Lord Howarth
The rest of the debate was almost all positive. Lord Dubs succumbed to the ‘skunk’ myth but who can blame him. given the level of propaganda and hysteria promoted even by ‘public service broadcasters’ such as Channel 4 and and some of our so-called eminent ‘scientists’. Lord Howarth of Newport hit the nail on the head and referred to the terrible difficulty of those who need access to Bedrocan. He is a stalwart ally of a few, fortunate CLEAR members whose doctors have had the courage to prescribe.
This mini debate was good news. It was another brick in the wall. Clearly, attitudes are changing and the facts are beginning to overtake the myths. Many Lords and MPs are on our side.
As ever, the way forward is relentless, individual, lobbying and informing. We must keep telling truth to power, challenging misinformation and providing knowledge.
Today, in the House of Lords, progress was made.
Drugs Policy Goes To Police Minister.

The Home Office has confirmed that responsibility for the UK drugs strategy goes to Mike Penning, MP for Hemel Hempstead, the Minister for Policing, Crime and Criminal Justice.
This must be indicative of the attitude that we can expect from the new Conservative government. It would seem that this is a hardening of drugs policy as being a criminal justice issue rather than something to do with health.
Ironically, Penning is MP for a constituency that takes its name from the long history of cannabis cultivation in the UK. Hemel Hempstead means Hemel’s cannabis farm. Cannabis hemp was, of course, one of the most widely grown agricultural crops prior to the 20th century for its tremendous value as fibre for rope and textiles. Its history as a source of medicine has been largely forgotten but it was widely used and as many as half of all medicines in the British pharmacopoeia once contained cannabis. Without doubt cannabis was used as a recreational drug as well but the experiment of prohibition which began in 1928 has obscured all this history.
Penning is on record as a hardliner on drugs policy. In February 2015, he publicly rebuked Mike Barton, chief constable of Durham, saying:
“I do not agree at all with the chief constable of Durham. I have told him so and I will continue to tell him. Drugs are a scourge in our society and we must do everything we can to crack down on them.”
He has also twice submitted written questions asking how many deaths there have been from cannabis. Of course, on both occasions the answer has been none but it reveals a worrying lack of knowledge and suggests a readiness to listen to or even promote evidence-free scaremongering. He has also been responsible for the dreadful drug driving legislation, widely criticised by all informed parties and a classic example of bad lawmaking driven by the tabloid press rather than by evidence.
So this is very worrying and depressing news for those interested in drugs policy reform. CLEAR will be reaching out to Mr Penning through our network of supportive Tory MPs and we will be seeking a meeting as soon as possible to present our case. Most urgently we will seek his support for allowing the prescription of medicinal cannabis by doctors.
This reinforces my view that CLEAR’s strategy of engagement and persuasion is the correct way forward. Protests and making demands never have worked and never will, particularly with ministers like Penning.
Sometimes it seems that some UK politicians are oblivious to what is happening in the US, Uruguay, Israel and across Europe, not just on access to medicinal cannabis but on wider drugs policy reform. That will be another objective; to educate and inform him of policies that more enlightened jurisdictions are pursuing and the great benefits for public expenditure savings, new tax revenue, health, crime and Tory values of individual liberty and free enterprise.
For All The Hysteria About Cannabis And Psychosis, Here Are The Facts.
Charles Walker MP. A Scaremonger Without A Cause.
Charles Walker MP, Parliament’s cheerleader for the ‘skunk scaremongerers’ shot himself and his hysterical campaign in the foot yesterday.
He had submitted a parliamentary written question asking:
“…how many people under 18 years of age have been treated in NHS-funded mental health units for cannabis-induced psychosis in each of the last five years?”
The answer from Jane Ellison MP, minister of state at the Department of Health, must have gravely disappointed Mr Walker. She revealed there have been average of just over 28 ‘finished admission episodes’ for each of the past five years. That doesn’t necessarily mean 28 people as it could include the same person being admitted more than once.
Of course, each of these 28 cases is a tragedy for the people involved and nothing must distract from that but it clearly shows that in public health terms, ‘cannabis psychosis’ (which some senior psychiatrists don’t even believe is a genuine diagnosis) is virtually unheard of. So much for the endless newspaper columns, the endlessly repeated ‘studies’ that never reach any conclusion and the endless moralising and deceit from those who make money from this scare story – either from providing ‘therapy’ or by fleecing money from those prepared to fund so-called science that sets out to reach a pre-determined conclusion.
Of course, not only are these cases very, very few in number but they have arisen under the present policy of prohibition when the market is in the hands of criminals. How much could we reduce this number if government took a responsible approach and regulated the market? With proper quality control, age limits, better education and harm reduction surely we could make the cannabis market safer than it is in the hands of the criminal underworld?

So this is very, very bad news for Charles Walker, for his sponsor, Mary Brett of ‘Cannabis Skunk Sense’, for Peter Hitchens, David Raynes, Sarah Graham, Theresa May and hundreds of rehab clinics, therapists and charlatans who talk up the cannabis psychosis scare story. The Daily Mail and the Daily Telegraph, which systematically misrepresent and distort evidence on the subject are exposed for what they are. Even those on the reform side like Transform, who have chosen the dubious path of talking up cannabis as ‘dangerous’ in order to sell their consultancy services, are disgraced. Their credibility is destroyed. Their argument is false and it always has been.
The husband and wife team of Professor Sir Robin Murray and Dr Marta Di Fiori, have built up a family business in skunk scaremongering. Every year they release another ‘study’ which says almost exactly the same as the last one, never shows any causative effect but is relentlessly exaggerated and regurgitated for those who want to demonise cannabis and cannabis users. Their last point is always ‘more research is needed’. I wonder is there anyone stupid enough out there to continue funding this vendetta against the three million people in the UK that enjoy cannabis or use it as medicine? Similarly in Australia, Professor Wayne Hall and his colleagues at the National Cannabis Prevention and Information Centre, have built their careers and made a lot of money pursuing this futile goal of proof that cannabis cause mental illness. The figures prove them all wrong. They are all self-serving propagandists and deceivers, nothing more.
These figures are more than evidence, they are facts and they prove that ‘cannabis psychosis’ is such an infinitesimally small risk, that we really need to stop wasting so much time, energy and money on it. We need to get on, legalise, regulate and start bringing the market under proper control, stop wasting money on futile law enforcement and research and start generating tax revenue and providing therapeutic and financial benefits for the whole community.
When We Will See The Corrupt Elite In Jail?
We have had enough. The bankers got off scot free. Just a few MPs were made to pay for their expenses fraud. HSBC launders billions in drug cartel money and is fined, whereas poor people growing a few cannabis plants go to jail.
This Fairhead woman sits atop the tree of privilege and wealth yet she takes no responsibility and offers only excuses. Even if she is sacked tomorrow as she should be, it will have no impact on her lifestyle.
As the gap between rich and poor widens and the middle class disappears, Britain is becoming a more dangerous place. If the Westminster elite doesn’t take radical steps soon, perhaps even in Britain we may see the stirrings of violent revolution.
Something needs to happen to shock Cameron and his cronies out of their contemptuous and smug complacency. The same goes for the sickening hypocrites in Labour, the trade unions and the civil service.
As Cameron’s five year term as prime minister comes to an end, Britain is broken as never before.
CLEAR Medicinal Users Panel. Fifth Delegation To Parliament.

Today a further delegation from CLEAR met with Lynne Featherstone, the new Home Office minister with responsibility for drugs policy. She is the Liberal Democrat MP for Hornsey and Wood Green and was appointed to replace Norman Baker after he resigned in November 2014.
We invited Jonathan Liebling, Political Director of the United Patients Alliance (UPA) to accompany us and he gave eloquent testimony about his own use of medicinal cannabis. UPA has been doing excellent work in running a series of meetings up and down the country bringing medicinal users together. We hope there will be further co-operation between UPA and CLEAR.
Jonathan spoke about using cannabis to help with anxiety and depression, as did Kate Stenberg who has also used cannabis to deal with a chronic pain condition. Vicky Hodgson spoke about treating her scoliosis, COPD and cluster headaches. Roland Gyallay-Pap, related how he produced cannabis oil when his mother was diagnosed with pancreatic cancer and the great help it gave her with sleeping and eating in the final months of her life. Penny Fitzlyon talked about treating her MS with cannabis and how she has now been refused Sativex. It was obvious this had a big impact on the minister.
She listened to each of us very attentively and we all felt that she had taken genuine interest and understood our arguments, particularly about enabling UK patients to import Bedrocan medicinal cannabis.
We also presented Ms Featherstone with a pre-publication copy of the paper ‘Medicinal Cannabis: The Evidence’, which we have produced at the request of George Freeman MP, the Life Sciences minister. This is a literature review of the existing evidence on medicinal cannabis. It makes a powerful argument for the transfer of cannabis from schedule I to schedule II so that it may be prescribed by a doctor. Currently the paper is being peer-reviewed and we hope that it may itself be published in a scientific/medical journal shortly.
CLEAR has also recently delivered a briefing on medicinal cannabis to Nick Clegg, the Deputy Prime Minister and leader of the Liberal Democrats. We shared this with Ms Featherstone as well.
With the General Election fast approaching, all MPs, including minsters, are about to go into campaign mode. Nick Clegg is to cover drugs policy in a speech a Chatham House later this week. There may yet be further developments, specifically on medicinal cannabis as the election campaign unfolds. What is certain is that the new Parliament will represent a real opportunity for change and we have high hopes of real progress.
CLEAR Medicinal Users Panel. Fourth Delegation To Parliament.
There is real momentum building in Parliament on the issue of medicinal cannabis. The first thing George Freeman said this week when he welcomed us to the Department of Health was: “There is a lot of discussion going on in government about this subject”.
This is extraordinary progress, unimaginable as recently as 2012. Undoubtedly, developments in the US have raised cannabis up the political agenda. Through 2014, CLEAR has been well received by the Home Affairs Select Committee, the Home Office, the Department of Health, the Health Select Committee and just before Christmas I met with Baroness Meacher and Lord Howarth in the House of Lords. They are chair and treasurer, respectively, of the All Party Parliamentary Group for Drug Policy Reform. They are determined to push reform through to make medicinal cannabis available and have briefed one of the UK’s leading psychopharmacologists to prepare a review of existing evidence on the subject. Armed with this they have a plan to meet with key individuals in both Houses of Parliament and I have no doubt that they will succeed in changing minds.
Also this week, I met with advisors to Nick Clegg, the Deputy Prime Minister, in the very heart of government at the Cabinet Office. The Liberal Democrats are planning towards another coalition after the General Election and determined to see drugs policy form part of a new coalition agreement. Right at the front of their priorities is medicinal cannabis for which there is strong support from existing ministers, Lynne Featherstone at the Home Office and Norman Lamb at the Department of Health. Expect announcements in the run up to the election.
George Freeman is the Life Sciences Minister, responsible for medicines, NHS innovation, research, development, the MHRA and NICE. His role is as important as any other minister in achieving the reform we seek. He is another ally and has asked me to submit a paper setting out our proposals. Of particular importance is how medicinal cannabis could be regulated, either with a full Marketing Authorisation from the MHRA or possibly registration as a Tradional Herbal Medicine. The very fact that we are now discussing such detail is a measure of how far we have come.
So there is great cause for optimism at the start of 2015. We are closer than we have ever been before and this has been achieved by moving away from the old ‘protests’ and outdated campaigning ideas. I am confident that early in the new parliament we will see substantial progress.

Our Simple And Reasonable Request To UK Government.
In 1998, GW Pharmaceuticals was granted a licence to grow cannabis and its cannabis oil medicine, Sativex, is now approved but doctors are prevented from prescribing it because it is so fantastically expensive.
The Dutch government approves a cannabis medicine called Bedrocan which provides exactly the same as Sativex at a tiny fraction of the price. Sativex costs between £375 – £560 per month. Bedrocan costs £35 – £95 per month.
All we ask is that if a doctor prescribes Bedrocan, the Home Office should issue an import licence. This is a narrow, tightly defined reform that will not encourage illicit use but will provide enormous help to some very poorly people. DONATE HERE.
Further Background.
Every year, thousands of medicinal cannabis users are prosecuted for possessing or growing cannabis. Often it is the only medicine that helps them with chronic pain, fibromyalgia, MS, Crohn’s disease, epilepsy, depression or many of the conditions related to aging. It is also used to mitigate the side effects of chemotherapy and HIV/Aids treatments.
In November 2014, the Liberal Democrat MP Norman Baker resigned as a government minister because of the Conservatives’ refusal even to consider drugs policy reform. In July 2014 he met with members of CLEAR and publicly called for cannabis to be legalised for medicinal use. While America Legalises, Back In Blighty It’s Prejudice, Bigotry, Anti-Evidence And Contempt For The Electorate.
Overnight, voters in Alaska, Oregon and Washington DC have voted to legalise cannabis for recreational use.
The US island territory of Guam approved a ballot to legalise medicinal cannabis and Florida also voted for medicinal cannabis by 58% but it failed as a 60% vote is required. All over the US, smaller jurisdictions, counties, cities and towns, have also passed legislation on medicinal cannabis and decrimnalisation.
Last week in Britain we saw the shameful spectacle of just 21 MPs turning up to debate drugs policy for the first time in a generation. David Cameron, Theresa May and the Westminster elite are arrogant, out of touch and detached both from scientific evidence and public opinion.
Authoritarian, Illiberal, Out Of Touch.
Nothing can excuse this failure of our democracy. Britain is a laughing stock both in Europe and to the Americans. We are regressing into a caricature of Dickensian history. Little more than an ‘Old Curiosity Shoppe’ for tourists and the nostalgic. Our government is concerned only with vested interests, politicians lining their own pockets and an increasingly authoritarian and illiberal regime. These developments are humiliating for all those who cherish what was once Great Britain. Surely, even those unconcerned or opposed to cannabis legalisation, must begin to realise that Westminster is destroying our country from within. On this, the anniversary of Guy Fawkes’ failed attempt to blow up Parliament, who can doubt that he had the right idea?
Mark Reckless Should Sue Grant Shapps For Defamation.
Odious Slanderer And Wide Boy, Grant Shapps
The odious wide boy Grant Shapps, chair of the Tory party, has launched an attack on Mark Reckless which goes way beyond politics, it is defamation. Reckless should sue the slimy oik for every penny he has got.
I know a little about defamation from bitter, personal experience. Shapps is worth suing, he’s wealthy and when you are slandered, maliciously and deliberately and the person responsible can pay, he deserves to.
Let’s be clear, Shapps is a first rate scumbag. He made his fortune by selling despicable and fraudulent get rich quick schemes under a succession of false identities. That he is now chairman of the Tory party says everything about how far that once noble institution has fallen.
My experience also tells me that Reckless will find a legal team willing to work on a conditional fee agreement. There is no doubt that Shapps’ disgraceful words are deliberately calculated to cause serious damage to Reckless and it seems to me that his repeated accusations of lying are factually inaccurate or unsupportable opinion, spoken out of malice. This ticks all the boxes as required under the Civil Procedure Rules.
Resorting to law in politics is something that must only be done in the most serious and extreme of circumstances, when those engaged in defamation have breached every limit, every red line and every tenet of civilised behaviour. That is the basis on which I decided to launch legal action against my abusers back at the beginning of 2013 and I urge Mark Reckless to take similar action now.
He, as I did, has a wider responsibility. Shapps’ behaviour is beneath contempt and beyond redemption. It is so serious that a stand must be made. People who sink so low must be stopped in the interests of wider society – just as those who attacked me.
Shapps should also reflect on this – had he made his remarks after the writ for the Rochester and Strood by-election had been moved, he should now be facing criminal charges under section 106 of the Representation of the People Act 1983. Regrettably the maximum penalty is a fine of £5,000 but Shapps political career would then be finished. For that, the whole country would be grateful, whatever their political views. People who behave in the way that Shapps has, like those who defamed me, deserve everything they get. They should be made outcasts from civilised society and debate.

I write following your most recent further emails regarding Israel’s recent actions in the Occupied Palestinian Territories (OPTs).
It is indeed tragic that so many innocent civilians, including women and children, have been killed and injured. Ministers have made clear to all parties at every opportunity that the current situation is in no one’s interest, and is harmful to prospects for the Middle East Peace Process. We now have a 72 hour ceasefire. The Government’s objective is to make that permanent so the killing stops.
It is vital that all security operations are conducted with due care and proportionate use of force. There are hundreds of thousands of extremely vulnerable civilians in Gaza who bear no responsibility for the rocket fire and are suffering acutely from this crisis; and the Israeli defence forces estimate that 5 million Israeli civilians live within range of rockets fired from Gaza. Israel has a right to defend itself against indiscriminate rocket attacks, but it is vital that Gaza’s civilian population is protected. International humanitarian law requires both sides to distinguish between military and civilian targets and enable unhindered humanitarian access.
The UK is working with international partners to achieve three important goals. Firstly, Ministers will push for a lasting and durable ceasefire agreed by both sides that ends both the rocket fire and the Israeli operations against Gaza. This will require cooperation from all parties in Israel and the OPTs, as well as assistance from regional partners.
Secondly, the Government has committed to do all it can to help alleviate humanitarian suffering in Gaza. Given the rapidly deteriorating situation in Gaza, the International Development Secretary has decided to make more than £15 million available in emergency support including health care, clean water, blankets and cooking equipment to help the people affected by the violence in Gaza. This includes £6 million in new funding to help the UN Relief and Works Agency (UNRWA) provide immediate emergency assistance for over 100,000 people who are seeking shelter in their schools. DFID is also bringing forward £3 million in funding to help the International Committee of the Red Cross respond to the worsening situation and is spending £200,000 to repair UNRWA schools that are being used as shelters.
Finally, it is again important to re-iterate that a negotiated two-state solution remains the only way to resolve the conflict once and for all and to achieve a sustainable peace so that Israeli and Palestinian families can live without fear of violence. No other option exists which guarantees peace and security for both peoples. I can assure you the UK will work with all parties to make progress towards this goal.
I do not believe that imposing sanctions on Israel would be a constructive step. The UK has a productive relationship with Israel which enables us to express our views at senior levels very frankly. It is the Government’s assessment that imposing sanctions on Israel would lessen this influence, not increase it, and would not promote the urgent progress towards a two-state solution of the Israeli-Palestinian conflict which we want to see. However, I am appalled at reports of further civilian casualties in the vicinity of a UN-run school housing Palestinians displaced by the Gaza conflict in Rafah. The facts are not yet clear, but it is tragic that there are further losses of life in a place which is being used as a shelter. The UN is absolutely right to speak out.

Thank you for your reply.
You do an excellent job of presenting the government’s position. Forgive me for reminding you but you do not represent the government, you represent the people of South Dorset. I am sure we, like the majority of the UK, are horrified at the government’s inaction and acquiescence to Israeli conduct. If anything, present policy only seems to demonstrate how powerful and effective is the pro-Israel lobby. It seems to have successfully driven our government way off course from any morality and blinded it to the criminal actions of the apartheid, zionist state that is central to all the problems of the Middle East.
In sharp contrast, military and proactive humanitarian action has been launched within days in Iraq. We are told we have to prevent a “slaughter”, we have to break the “siege” in the Sinjar mountains, we must prevent “genocide”. Government ministers are wringing their hands over “brutal persecution” – the same ministers who have said nothing about Israel’s massacre of civilians in Gaza and genocide of the Palestinian people..
The hypocrisy is simply breathtaking and the cowardly, weasel words of those who call themselves our leaders are beneath contempt.
Democracy in the UK is nothing more than a sham. The BBC censors and controls the news clearly on government orders. Palestinian resistance fighters are “terrorists”, Israeli war crimes are excused and their propagandists are provided with great swathes of air time to present their arguments, unchallenged and untested while they continue to murder children with impunity.
Israel has no right to defend itself when it is acting unlawfully. It is in breach of 64 UN resolutions. Its settlements, apartheid policies and occupation of Palestinian land are unlawful. It is the rockets that are weapons of self defence.
Israel has committed repeated and heinous war crimes by targeting civilian areas and reckless attacks where it is clear there will be civilian casualties. What is Britain doing to bring these criminals to justice?
We quite clearly do not have a “productive relationship” with Israel. The kindest word that can be used to describe this claim is disingenuous. We have to draw a line. We must not permit an outlaw, renegade state, run by war criminals, to pursue its racist persecution of the Palestinian people. Israel’s fanatacism is every bit as evil as that of ISIS. indeed, if we had dealt justly with the Palestinian people and protected them against Israel, the West would not now be facing such an enraged, dangerous enemy.
Finally, there is simply no excuse at all for supplying anything to Israel that can help it to sustain its present policy. If we are still supplying arms then those concerned must be arrested immediately and brought to justice.
There is no hiding place for ministers or MPs on this Richard, no immunity against prosecution for being culpable in supporting war crimes. Please take a stand. You do not represent the government, you represent the people of South Dorset. Stand up to the corruption and cowardice in Whitehall. Resign if our government will not pursue a moral path. That would gain you more support than any toeing of the party line or repeating government propaganda.
If there is concern that Israel would use its nuclear weapons if challenged, then please have the decency to say so.
